ATO DIAT N° 09, de 29.05.03 (Trans.Créditos)

Vide
Atos Diat 13/03 e 17/03 que alteram parcialmente o presente ato.
Autoriza as transferências de créditos de ICMS acumulados.
O DIRETOR DE ADMINISTRAÇÃO TRIBUTÁRIA, no uso
de sua competência e considerando o disposto no Regulamento do ICMS aprovado
pelo Decreto nº 2.870, de 27 de agosto de 2001, art. 50, § 6º.
RESOLVE:
Art. 1º Autorizar as transferências de créditos de
ICMS acumulados, conforme relação constante no Anexo Único deste Ato, no
valor total de R$ 7.986.492,15.
§ 1 º Os valores dos créditos relacionados no
Anexo
Único somente poderão ser lançados à vista da primeira via da
nota fiscal que contenha o número do processo e deste Ato.
§ 2º A autorização de transferência dos
créditos de ICMS não implica o reconhecimento da legitimidade do saldo credor
acumulado nem a homologação dos lançamentos efetuados pelo contribuinte.
Art. 2º Retificar o Ato Diat n º
07/2003, em relação a Nota Fiscal n º 3233, emitida por Acafe
Ind. Com. Calçados e Comp. Ltda., CCICMS n º 253.510.317, no valor de R$
15.957,20, cujo destinatário é Embacril Embalagens Criciúma Ltda. CCICMS
nº 253.744.270, e não como constou do
referido Ato.
Art. 3º
Tornar sem efeito, a pedido do contribuinte, as autorizações para transferência de
créditos relativas a Nota Fiscal n º 157.787, constante do Ato Diat n º 05/2003, de 15/04/2003, e
as Notas Fiscais n º 163.527 e 163.528, constantes do Ato
Diat n º 06/2003, de 29/04/2003, emitidas por Empresa Brasileira
de Compressores S/A – Embraco.
Art. 4º O presente Ato deverá ser divulgado pela
Internet, no site da Secretaria de Estado da Fazenda –
http://www.sef.sc.gov.br.
Art. 5º Este
Ato entra em vigor na data de sua publicação.
