ATO DIAT N° 30, de 31.08.04 (Trans.Crédito)
Este texto não substitui o publicado no D.O.E de 31.08.04
Autoriza as transferências de créditos de ICMS acumulados e retifica ou cancela autorizações de transferências de crédito, publicadas em Atos anteriores.
O DIRETOR DE ADMINISTRAÇÃO TRIBUTÁRIA, em exercício, no uso de sua
competência e considerando o disposto no Regulamento do ICMS aprovado pelo
Decreto nº 2.870, de 27 de agosto de 2001, art. 50, § 6º,
RESOLVE:
Art. 1º Autorizar as transferências de créditos de ICMS acumulados, conforme
relação constante no Anexo Único deste Ato, no valor total de R$
12.999.839,88.
§ 1 º Os valores dos créditos relacionados no Anexo Único somente poderão
ser lançados à vista da primeira via da nota fiscal que contenha os números do
processo e deste Ato e as assinaturas do FTE que analisou o respectivo processo
de transferência de crédito e do Gerente Regional da Fazenda que homologou a
análise.
§ 2º A autorização de transferência dos créditos de ICMS não implica o
reconhecimento da legitimidade do saldo credor acumulado nem a homologação dos
lançamentos efetuados pelo contribuinte.
Art. 2º Em relação ao Ato DIAT n º 27/2004:
a) O número correto da nota fiscal cujo requerente é Dohler S/A é 487.925;
b) No processo de nº GR08 52.699/03-0, o nome correto do requerente é Adacir
Domingos Zamboni e o número correto da nota fiscal é 131; c) o número correto
do processo de Mário Evilasio Garbelotto é GR11 17.204/04-6.
Art. 3º O presente Ato deverá ser divulgado pela Internet, no site da Secretaria
de Estado da Fazenda – http://www.sef.sc.gov.br.
Art. 4º Este Ato entra em vigor na data de sua publicação.
